- Understand, I don't condone the parking of a repeater on a simplex
- frequency, in violation of the band plan. That's just a sign that (1)
- coordination in Los Angeles has gone to hell, and (2) nobody gives a damn
- about what other people want to do in the band.

- However, two wrongs don't make a right. Now that you *know* that there
- is a repeater on that frequency, and the rules state that you are not
- to cause deliberate interference, continuing to transmit *knowing* that
- you are sitting on the input freq could be construed as deliberate
- interference.

- Yes, the band plans "are generated within the amateur ranks, not from the
- desk of the FCC" (from 9th Edition, 1993, FCC Rule Book Guide to the FCC
- Regulations. Published by the ARRL page 10-11).

- planning for the Amateur Radio service frequencies that has come to our
- attention is that done by the American Radio Relay League.......In view of
- this widespread acceptance of their band plans, we conclude that any amateur

- As we all know 97.101 clearly states (at least part (a) of 97.101 does) that
- we must operate in accordance with good amateur practice. This is effective
- only if the FCC has not set aside a portion(s) of some band(s) for a specific
- mode (this is from the book; same source as before). Look at the plans for
- each band in Chapter 5 of the above book.

- 1. Go to that committee BEFORE you buy.

- 2. Get any agreement in writing, and have your own attorney approve
- the language.

- your attorney don't like the language of the deal, or you can't get
- one at all.
